Terms and Conditions.

  1. Instructors have the discretion to refuse participation of a client in any class for reasons including but not limited to, late arrival, inappropriate attire, rudeness and unpaid fees.

  2. Bookings for classes are valid only until the class start time.

  3. A request to place a membership ‘on hold’ or to ’opt out’ must be made via email to enquiries@yourstudiocbr.com.au.

  4. A request to place a membership ‘on hold’ must include start and end dates.

  5. A member ‘on hold’ will automatically become active after the hold period expires, unless Your Studio receives prior written notification requesting for the hold date to be extended. Requisite fees and the maximum hold period MUST be adhered to.

  6. On hold payments are payable upfront, are non-refundable and for a single ‘on hold’ period. The minimum ‘on hold’ period is 7 consecutive days and the maximum ‘on hold’ period is 12 consecutive weeks.

  7. 4 weeks’ notice, as an active paying member, must be provided to ‘opt out’. 

  8. A member who is ‘on hold’ and wishes to cancel their membership must notify Your Studio of their intention to cancel and either 

    a. reinstate as an active paying member for an additional 4 weeks OR

    b. pay a cancellation fee equivalent to a 4 week active paying membership.

  9. A membership will only be terminated once a member has followed the ‘opt out’ procedure, paid the ‘opt out’ fee and all outstanding monies owing. 

  10. Lucas Studios fees are non-refundable and may change without notice.

  11. Consent for photos or videos taken at Your Studio is implied. Images and videos can be used on social media and/or for general marketing purposes.

  12. You indemnify Your Studio for any fees incurred by Ezidebit regardless of circumstances.

    LUCAS STUDIOS CONDITIONS OF ENTRY

    The Member is entitled to use of Your Studio’s facilities subject to these Conditions of Entry. For the purposes of these Conditions of Entry, the term “Member” includes, but is not limited to, (a) a visitor, and (b) the parent or guardian of the Member if the Member is under 18 years.

  13. The Member warrants that they are not aware of any physical or mental disability, conditions or diseases which might be aggravated or worsened by physical exercise or which could result in deterioration of health if physical exercise is undertaken

  14. The Member acknowledges that Your Studio offers no warranty that the facilities or activities that are available to the Member are fit for the physical limitations of the Member.

  15. In consideration of Your Studio’s provision of its facilities and activities (and except to the extent that may be precluded by law) the Member agrees as follows:
    The Member uses Your Studio’s facilities at the Member’s sole risk and responsibility;
    The Member agrees to release, indemnify and hold harmless Your Studio, its servants, employees, agents and contractors, from and against all and any actions or claims which may be made by the Member or on the Member’s behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to the Member or the Member’s property whether by negligence, breach of contract or in any way whatsoever;
    In the event that the Member is a parent or guardian of person under the age of 18 years, the Member will be solely responsible for the supervision of that underage person;
    If a person accompanies you but is not participating in a class/session, you assume all risk and responsibility for any injury, death or property damage in relation to that person;

  16. In the event that the Member is injured or the Member’s property damaged or lost, the Member will bring no claim, legal or otherwise, against Your Studio in respect of that injury, damage or loss.

  17. The Member acknowledges and understands that:
    Using Your Studio’s facilities, or participating in its activities, may constitute a dangerous recreational activity and that by participating in this activity the Member is exposed to certain risks, including physical and/or mental harm;
    Other persons using Your Studio’s facilities may cause the Member injury and/or damage to their property;
    the Member’s property may be lost or damaged during the Member’s use Your Studio. Your Studio will not be liable for the loss of or damage to the Member’s property. This includes, but is not limited to, the use of any lockers located within Your Studio.

  18. The conditions in which the activities, and use of facilities, is conducted at Your Studio may vary without warning;
    The Member has had the opportunity to seek assistance from Your Studio’s staff to enhance the Member’s understanding of Your Studio’s facilities prior to participation;
    The Member has reporting obligations to Your Studio under the Work Health and Safety Act 2011 (ACT) as a visitor to Your Studio.

  19. The Member assumes the risk and responsibility for any injury, death or property damage resulting from the Members use of Your Studio’s facilities, and participation in its services.

  20. The Member warrants to Your Studio:
    The Member has sought medical advice, or had the opportunity to seek medical advice and elected not to do so, before participating in the activities, and/or using the facilities, available at Your Studio;
    The Member is capable of using Your Studio’s facilities;
    In the event that the Member does become aware of any potential safety risk, or injury, the Member will immediately notify a Your Studio employee.
